Right of Withdrawal

This is an English translation provided for your convenience. In case of any discrepancy, the German version ("Widerrufsbelehrung") is legally binding, and German law (Bürgerliches Gesetzbuch, BGB) applies.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by a clear statement (e.g. a letter sent by post, fax, or email). You may use the attached model withdrawal form, but this is not required.

You can also exercise your right of withdrawal online via our form at https://pretty-plants.com/apps/widerruf. If you use this online option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by email) without delay, including the content of the withdrawal notice as well as the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send your notice concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back, or until you have provided proof that you have sent the goods back, whichever is earlier.

You must send back the goods or hand them over to us without undue delay, and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods if this diminished value results from handling of the goods that was not necessary to establish their nature, characteristics, and functioning.

Additional Notice: Handling of Plants During the Withdrawal Period

Until the withdrawal period has expired, plants must be handled with care. Only handling that would also be possible in a physical store is permitted – for the purpose of checking the nature, characteristics, and functioning of the goods.

In particular, the following must be avoided: repotting, changing the substrate, pruning, propagation, and any care measures beyond what is customarily required in the short term (e.g. fertilizing or the use of pesticides).

To preserve the original condition of the goods, we recommend keeping the plant separate from other plants until the withdrawal period has expired, in order to avoid the risk of transmitting pests or diseases.

If handling beyond what is necessary to check the nature, characteristics, and functioning of the goods results in deterioration or alteration of the goods (e.g. through repotting, changing the substrate, damage, or pest or disease infestation), this may – as described above under "Consequences of Withdrawal" – give rise to a claim for compensation for diminished value pursuant to Section 357a (1) of the German Civil Code (BGB). If the plant is thereby no longer saleable, or only saleable to a limited extent, this compensation may, in individual cases, amount to the full value of the goods.

Please return the goods, if possible, in their original packaging, together with all accessories and packaging components. Original packaging is not a requirement for the valid exercise of the right of withdrawal; if it is no longer available, please use suitable packaging to prevent damage during transport.
