General Terms and Conditions (GTC)

This is an English translation provided for your convenience. In case of any discrepancy, the German version ("Allgemeine Geschäftsbedingungen") is legally binding, and German law (Bürgerliches Gesetzbuch, BGB) applies.
§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed via the Pretty Plants online shop (proprietor: Céline Merkle) at pretty-plants.com. Deviating terms of the buyer will not be recognized unless we expressly agree to their validity in text form.
§ 2 Contracting Party

§ 3 Formation of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking the "Buy now" button, you submit a binding order for the goods contained in your shopping cart and expressly confirm that you are entering into a payment obligation (Section 312j (3) of the German Civil Code, BGB).
The purchase contract is concluded once we accept your order by sending an order confirmation by email.
As plants from our stock are also sold at our market stall, it may occur that an ordered plant is no longer available at the time of the order. In this case, we will notify you without delay by email and, where available, offer you an equivalent alternative at the originally agreed price. If you do not want the alternative, or do not respond within 5 business days, we will refund any payments already made without delay and in full; no contract will be formed in this respect.
§ 4 Prices and Shipping Costs
All prices stated are final prices in euros and include statutory value-added tax. Shipping costs may apply in addition to the stated prices; these are shown on the respective product page and, at the latest, during the checkout process before the order is completed.
§ 5 Payment
Payment is made using the payment methods shown during the checkout process. If the chosen payment method provides for immediate debit (e.g. credit card or PayPal), your account will be charged upon completion of the order.
§ 6 Delivery
We deliver within Germany as well as to all other European countries, with the exception of Norway, Switzerland, and the United Kingdom (UK). Delivery generally takes 3–7 business days, unless stated otherwise. For plants and other living goods, we take care to ensure professional, transport-safe packaging.
Our plants are intended for ornamental use only and are not suitable for consumption by humans or animals. For plants known to be toxic, we provide an additional warning on the respective product page. Please keep plants out of the reach of small children and pets.
We recommend keeping newly delivered plants separate from your existing plant collection for a few days, to avoid the possible transmission of pests, and waiting a few days before repotting, to allow the plant to recover from transport.
§ 7 Right of Withdrawal
As a consumer, you have a statutory right of withdrawal pursuant to Section 355 BGB. Details – including the deadline, requirements, legal consequences, guidance on handling the goods during the withdrawal period, and the model withdrawal form – are set out in our separate Right of Withdrawal notice, which will be provided to you in text form no later than upon receipt of the goods.
§ 8 Warranty
Statutory warranty rights apply (Sections 434 et seq. BGB). These rights exist regardless of when a defect is reported.
For obvious transport damage, we kindly ask that you report it promptly – ideally within 24 hours of receiving the goods, with photos, by email to hello@pretty-plants.com. This request is intended to help us process your matter quickly and does not limit your statutory warranty rights.
§ 9 Liability
We are liable without limitation for damages arising from injury to life, body, or health, as well as for damages caused by intent or gross negligence. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
In the case of slightly negligent breach of material contractual obligations (cardinal obligations – obligations whose fulfillment is essential for the proper performance of the contract and on whose observance you may regularly rely), our liability is limited to the typical, foreseeable damage. Beyond that, liability for slightly negligent breaches of duty is excluded.
§ 10 Data Protection

§ 11 Final Provisions
The law of the Federal Republic of Germany applies. The place of performance and jurisdiction is Neu-Ulm, insofar as the buyer is a merchant, a legal entity under public law, or a special fund under public law.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
§ 12 Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of Section 36 of the German Consumer Dispute Resolution Act (VSBG).
